Battery Waste Management Rules 2022: Ensuring Sustainable Battery Recycling
Because of the rapid growth of renewable energy and the transition away from fossil fuels, demand for batteries has skyrocketed in recent years. As the world embraces emission-free electrification, batteries have emerged as a critical storage solution. However, the transition to renewable energy poses a challenge in the form of increased battery waste.
The government has taken proactive measures to address the growing problem of battery waste. The Ministry of Environment, Forests, and Climate Change published the Battery Waste Management Rules 2022 on August 22, 2022. The purpose of these rules, which replace the Battery (Management & Handling) Rules, 2001, is to ensure the environmentally sound management of used batteries.
Producer Registration: Rule 4 of the BWM Rules 2022 requires every battery producer and entity involved in battery manufacturing to register with the Central Pollution Control Board (CPCB) via a centralised online portal. The CPCB requires the submission of Form 1(A) during the registration process. Producers are also required to renew their registration sixty days before it expires by filing Form 1(A).
A producer, as defined by the BWM Rules, 2022, is an entity that manufactures, sells, and imports batteries, including refurbished batteries, either under its own brand or produced by other manufacturers or suppliers.
Extended Producer Responsibility (EPR): The BWM Rules are based on the concept of Extended Producer Responsibility. This means that battery manufacturers are responsible for collecting, recycling, and refurbishing used batteries. They are also encouraged to use recovered materials from waste batteries in the manufacture of new batteries. Registration of Refurbishers and Recyclers: Refurbishers and recyclers must also register with the State Pollution Control Board via the centralised portal. They must submit quarterly Form 4 returns detailing the quantity of used batteries collected, refurbished and recycled batteries, and hazardous or other waste generated during the process.

Transition to Online Portal: While the online centralized portal of the CPCB is currently under development, applications for registration are being accepted offline. To submit an offline application, follow these steps:
Documentation: Compile and prepare all the required information and documents as per CPCB norms.
Application Submission: Submit the prescribed application form along with the necessary documents to the Central Pollution Control Board via mail and hardcopy.
Review of Application: The CPCB will review the application upon receipt.
Grant of Registration: After reviewing the application, the CPCB will grant registration initially for six months. Once the online portal becomes operational, registration can be renewed for an additional six-month period. Application fees will be deferred and collected during registration through the centralized online portal.
