Cloudtail’s Appeal Dismissed by NCDRC in Pressure Cooker Quality Case

Introduction: In a recent development, the National Consumer Disputes Redressal Commission (NCDRC) has rejected an appeal submitted by Cloudtail India Pvt Ltd. The appeal challenged a ruling issued by the Central Consumer Protection Authority (CCPA) regarding the sale of substandard pressure cookers. The CCPA had imposed a fine of ₹1 lakh on Cloudtail and instructed the company to rectify the situation.

Background: Cloudtail India Pvt Ltd, a prominent seller on Amazon’s platform, had marketed an “Amazon Basics Stainless Steel Outer Lid Pressure Cooker, 4 L (does not give pressure alert by whistle).” This product came under scrutiny for failing to meet the prescribed quality standards set by the Quality Control Order (QCO) for pressure cookers. The QCO mandates that only domestic pressure cookers adhering to Indian standards and carrying the Bureau of Indian Standards (BIS) standard mark are permissible for sale.

Violation of Quality Standards: The CCPA investigation uncovered that Cloudtail was distributing domestic pressure cookers to consumers without complying with the mandatory quality benchmarks and without the required ISI mark, signifying BIS approval. The company’s actions were in direct contravention of the QCO guidelines. Notably, Cloudtail continued to market these uncertified pressure cookers even after the implementation of the QCO.

CCPA’s Directive: The CCPA took a decisive stance in response to Cloudtail’s violation of quality standards. The authority directed Cloudtail to pay a penalty of ₹1 lakh for their disregard of quality norms. Furthermore, the company was instructed to initiate a product recall for a total of 1,033 units of the deficient domestic pressure cookers that had been sold. Additionally, Cloudtail was directed to reimburse the affected consumers for their purchases.

NCDRC’s Verdict: Cloudtail’s attempt to challenge the CCPA’s ruling through an appeal was recently addressed by the NCDRC. However, the commission upheld the CCPA’s decision and rejected Cloudtail’s appeal. Consequently, the company remains obligated to pay the stipulated penalty and proceed with the product recall and consumer reimbursement as per the CCPA’s directives.
